1. Introduction

DESIGNOMATE (“we”, “us”, or “our”) operates the Playy Spin Wheel Discount Code application (the “App”), available on the Shopify App Store. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you install and use our App on your Shopify store, and when your store visitors interact with the spin wheel popups and discount coupon popups powered by the App.

By installing or using the App, you (the Shopify merchant) agree to the terms of this Privacy Policy. If you do not agree, please uninstall the App and discontinue use.

2. Information We Collect

2.1 Information from Shopify Merchants

When you install the App, we access the following data from your Shopify store as part of the necessary permissions:

  • Store Owner Information:
Name, email address, phone number, and physical address of the store owner.
  • Customer Data:
Customer records within your Shopify store, used to sync leads captured via the App.
  • Product and Inventory Data:
Products, inventory levels, and collections, used to enable targeting and campaign configuration.
  • Discount Codes and Promotions:
Discount codes and promotional data to create and manage auto-generated discount coupons delivered via the popups.
  • Theme and Store Files:
Access to your store theme and files to embed the popup widget on your storefront.
  • Sales Channel Publications:
Product publication data across sales channels for campaign targeting purposes.

2.2 Information from Store Visitors (End Users)

When visitors interact with the spin wheel or discount popup on your Shopify storefront, the App collects the following:

  • Email Address:
Voluntarily submitted by the visitor to participate in the spin wheel or receive a discount coupon.
  • Phone Number:
Voluntarily submitted for SMS-based lead capture. Phone numbers may be verified via OTP (One-Time Password) authentication.
  • Behavioral Data:
Interaction data such as popup views, spin events, and coupon claims, used for campaign analytics and reporting.

2.3 Automatically Collected Data

The App may automatically collect technical information including browser type, device type, IP address, pages visited, and referral source. This data is used solely for analytics, debugging, and improving App performance.

3. How We Use the Information

We use the collected information to:

  • Operate and provide the App features, including spin wheel popups, discount coupon popups, and lead capture functionality.
  • Generate, manage, and deliver discount codes to end users who interact with popups.
  • Authenticate end users via OTP verification for email or mobile number submissions.
  • Sync captured leads (email addresses and phone numbers) to your connected third-party marketing platforms (Brevo, Klaviyo, Mailchimp, SendGrid), as configured by you.
  • Provide campaign analytics, A/B testing results, and performance tracking dashboards within the App.
  • Trigger smart display rules based on page scroll depth and time-on-page settings configured by the merchant.
  • Communicate with merchants regarding App updates, support, or service changes.
  • Comply with legal obligations and enforce our Terms of Service.

4. Sharing and Disclosure of Information

We do not sell, rent, or trade your personal information or your customers’ personal information to third parties. We share data only in the following circumstances:

  • Shopify Platform:
The App operates on the Shopify platform and is subject to Shopify’s data policies. Data shared with Shopify is governed by Shopify’s Privacy Policy.
  • Third-Party Integrations (at your direction):
When you connect Brevo, Klaviyo, Mailchimp, or SendGrid, captured lead data (email addresses and/or phone numbers) is transmitted to those platforms per your configuration. Each platform’s own privacy policy governs that data.
  • Service Providers:
We may share data with trusted third-party vendors who assist in operating the App (e.g., hosting, OTP delivery). These providers are contractually required to maintain confidentiality.
  • Legal Requirements:
We may disclose information when required by law, court order, or governmental authority, or to protect our rights and the safety of others.

5. Data Retention

We retain merchant account data for as long as the App is installed on your store. Lead data (email addresses and phone numbers of store visitors) is retained for the duration of your use of the App or until you request deletion.

Upon App uninstallation, we will delete or anonymize your store data within 30 days, unless a longer retention period is required by law or for legitimate business purposes such as dispute resolution.

6. Cookies and Tracking Technologies

The App uses cookies and similar tracking technologies on your store’s frontend to manage popup display logic. This includes remembering whether a visitor has already seen or interacted with a popup, tracking scroll depth, and measuring time on page to determine when to trigger a popup. These cookies do not track users across other websites.

As a merchant, you are responsible for ensuring your store’s cookie consent notice (if required in your jurisdiction) adequately discloses the use of these cookies to your visitors.

7. Data Security

We implement commercially reasonable technical and organizational measures to protect the information we process against unauthorized access, alteration, disclosure, or destruction. These include encrypted data transmission (HTTPS/TLS), access controls, and regular security assessments.

However, no method of transmission over the internet or electronic storage is completely secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

8. Your Rights and Choices

8.1 Merchant Rights

As a merchant using the App, you may:

  • Request access to or correction of the data we hold about your store and account.
  • Request deletion of your data by uninstalling the App and contacting us at the address below.
  • Disconnect third-party integrations (Brevo, Klaviyo, Mailchimp, SendGrid) at any time through the App’s settings.

8.2 End User Rights (Your Customers)

End users (your store visitors) who have submitted their data via the App’s popups may request access to, correction of, or deletion of their personal data. As the merchant, you are the data controller for your customers’ data and are responsible for handling such requests. You may also contact us to assist with data deletion requests on behalf of your customers.

9. International Data Transfers

DESIGNOMATE is based in Noida, Uttar Pradesh, India. If you are located outside India, your information may be transferred to and processed in India or other countries where our service providers operate. By using the App, you consent to such transfers. We take steps to ensure appropriate safeguards are in place for international data transfers in accordance with applicable laws.

10. GDPR Compliance (EEA Merchants and Visitors)

If you operate a store serving customers in the European Economic Area (EEA), the UK, or Switzerland, the General Data Protection Regulation (GDPR) and applicable local laws may apply.

The legal basis for our processing of personal data is: performance of a contract (providing the App’s services to you), legitimate interests (analytics and App improvement), and consent (where end users voluntarily submit their email or phone number via popups). You are responsible for ensuring your store’s popup forms include appropriate consent language and disclosures required under GDPR before collecting visitor data.

EEA residents have rights to access, rectification, erasure, restriction of processing, data portability, and to object to processing. To exercise these rights, contact us at the address in Section 13.

11. CCPA Compliance (California Residents)

If you or your store visitors are California residents, the California Consumer Privacy Act (CCPA) may grant additional rights, including the right to know what personal information is collected, the right to request deletion, and the right to opt out of the sale of personal information. We do not sell personal information. To exercise CCPA rights, contact us at the address in Section 13.

12. Children’s Privacy

The App is not directed at children under the age of 13, and we do not knowingly collect personal information from children. If you believe a child has submitted personal data through the App on your store, please contact us immediately so we can take appropriate action.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or App features. When we do, we will revise the “Last Updated” date at the top of this page. We encourage you to review this policy periodically. Continued use of the App after changes are posted constitutes your acceptance of the revised policy.
